Terms of Service

By accessing or using the IFO4 platform, website, certification programs, learning materials, examination systems, and any associated services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the International Financial Operations Standards Organization ("IFO4," "we," "us," or "our"). IFO4 reserves the right to modify these Terms at any time, and your continued use of the Platform following any such modifications constitutes your acceptance of the revised Terms.

If you are accessing or using the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. In such case, "you" and "your" shall refer to such entity.

To access certain features of the Platform, including certification programs, examination scheduling, learning resources, and community features, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any authentication tokens. You agree to notify IFO4 immediately of any unauthorized access to or use of your account. IFO4 shall not be liable for any loss or damage arising from your failure to maintain the security of your account.

You may not create multiple accounts for the purpose of circumventing Platform restrictions, examination policies, or certification requirements. IFO4 reserves the right to suspend or terminate accounts that violate these provisions.

The Platform is provided for lawful purposes related to professional development, certification, learning, research, and community engagement within the Financial Operations discipline. You agree not to use the Platform in any manner that violates applicable local, state, national, or international laws or regulations.

Prohibited activities include, but are not limited to: (a) attempting to gain unauthorized access to any portion of the Platform or any systems or networks connected thereto; (b) using automated tools, bots, scrapers, or similar technologies to access or collect data from the Platform; (c) interfering with or disrupting the Platform or servers or networks connected thereto; (d) impersonating any person or entity or misrepresenting your affiliation with any person or entity; (e) engaging in any activity that could disable, overburden, or impair the Platform.

IFO4 reserves the right to investigate and take appropriate legal action against anyone who, in IFO4's sole discretion, violates this provision, including without limitation, removing offending content, suspending or terminating the account of such violators, and reporting such activity to law enforcement authorities.

IFO4 certifications, including CFOA, CFOP, CFOE, CFOGP, and any future credentials, are professional designations awarded upon successful completion of examination requirements and compliance with all applicable policies. Certification is granted at the sole discretion of IFO4 and is subject to ongoing compliance with recertification and continuing education requirements.

Examinations are administered through IFO4's secure proctoring system, which may include AI-based monitoring, webcam surveillance, screen recording, gaze tracking, and environmental audio analysis. By registering for an examination, you consent to the use of these monitoring technologies and agree to comply with all examination conduct policies.

Any form of cheating, plagiarism, unauthorized assistance, or violation of examination integrity policies will result in immediate disqualification, revocation of certification, and potential permanent ban from all IFO4 programs. IFO4 reserves the right to withhold, revoke, or invalidate any certification at its sole discretion if it determines that the certification was obtained through fraudulent or dishonest means.

Examination fees are non-refundable except as expressly provided in IFO4's Examination Refund Policy. Rescheduling of examinations is subject to applicable fees and availability.

All content, materials, software, trademarks, service marks, logos, and other intellectual property displayed on or made available through the Platform (collectively, "IFO4 Content") are the property of IFO4 or its licensors and are protected by applicable intellectual property laws. This includes, without limitation, certification materials, examination content, frameworks, methodologies, standards documents, research publications, course materials, and assessment tools.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and IFO4 Content solely for your personal, non-commercial use in connection with your participation in IFO4 programs. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any IFO4 Content without the prior written consent of IFO4.

The IFO4 name, logo, certification marks (CFOA, CFOP, CFOE, CFOGP), and all related names, logos, product and service names, designs, and slogans are trademarks of IFO4. You may not use such marks without the prior written permission of IFO4, except as permitted under IFO4's Credential Usage Guidelines for active credential holders.

The Platform may allow you to submit, post, or share content, including but not limited to discussion forum posts, comments, profile information, study group contributions, and community resources ("User Content"). You retain ownership of your User Content; however, by submitting User Content to the Platform, you grant IFO4 a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content.

You represent and warrant that: (a) you own or have the necessary rights and permissions to submit your User Content; (b) your User Content does not infringe upon the intellectual property rights or other rights of any third party; (c) your User Content does not contain any defamatory, obscene, or otherwise unlawful material.

IFO4 reserves the right to remove any User Content that violates these Terms or that IFO4 deems inappropriate, offensive, or harmful in its sole discretion, without prior notice.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy, including the collection of biometric and behavioral data during proctored examinations.

Certain features of the Platform, including certification examinations, courses, membership plans, and premium resources, require payment. All fees are stated in US Dollars unless otherwise specified. You agree to pay all applicable fees in connection with your use of paid features of the Platform.

Payments are processed through our third-party payment processor. By providing payment information, you represent and warrant that you are authorized to use the designated payment method. IFO4 is not responsible for any fees charged by your financial institution in connection with your transactions on the Platform.

Membership subscriptions will automatically renew at the end of each billing period unless you cancel prior to the renewal date. Refunds for membership fees are subject to IFO4's Refund Policy. Certification examination fees, once paid, are subject to the Examination Refund Policy and may not be fully refundable.

IFO4 reserves the right to modify pricing at any time. Any price changes for active subscriptions will take effect at the beginning of the next billing cycle following notice of the change.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IFO4, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL IFO4'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO IFO4 IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IFO4 DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the State of Delaware.

You agree to submit to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such action or proceeding in such courts. Any claim or cause of action arising out of or relating to these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

IFO4 reserves the right to modify or replace these Terms at any time at its sole discretion. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at IFO4's sole discretion.

We will notify you of changes by posting the updated Terms on the Platform and updating the "Last Updated" date at the top of these Terms. We may also send you notification of material changes via email to the address associated with your account.

By continuing to access or use the Platform after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Platform.
